License Agreement
The following terms and conditions constitute a contract between Alinof Software GmbH and you. Read them carefully. They relate to our software as well as to the medium on which you received it. These terms also apply to software updates, unless other terms accompany those products. In this case, these conditions will prevail.
THE USE OF OUR SOFTWARES IS CONDITIONED BY THE ACCEPTANCE OF THIS LICENSE AGREEMENT. IF YOU DO NOT ACCEPT IT, DON’T USE OUR SOFTWARES.
Our softwares are developed by the company Alinof Software GmbH. The purpose of this License Agreement is to regulate the methods of the transfer, to the taker of license, and the use of the software for an unlimited duration. We herewith specify that it is only a transfer of the right to use the software and not a transfer of the property right. Alinof Software GmbH remains the exclusive owner of the software. The software is given under license and not sold. This License Agreement gives you only certain rights for the use of the software. All the other rights are reserved to Alinof Software GmbH.
The license gives only the right, for the taker of license, to use the software in an exclusive way. The taker of the license commits himself not to sell, rent, lend, give or remit to a third, in any kind of manner, the software and the corresponding license. The license is personal and non transmissible. The software will be exclusively delivered in the version which could be used and read directly by the computer. It is strictly prohibited for the taker of license to modify, copy, adapt, decompile or to disassemble, the software in any kind of manner. The violation of one of these clauses will constitute a right reason of denunciation and immediate cancellation of this contract. In exemption from what precedes, the taker of license has the right to proceed to a backup copy of the software; this specimen will have to reproduce obligatorily the mentions of property mentioned on the original example under license. You can use it only to reinstall the software. A license is granted for a user or a work station.
The current License Agreement has an unlimited duration. It comes into effect at the acceptance of these conditions.
Intellectual Property
In its capacity as author, Alinof Software GmbH guarantees that it is the only holder of the intellectual property right relating to the software and to the documentation. The royalties apply to all components of the software. They also relate to information, documentation and programs which would be communicated to the license holder, regardless of support.
Modifications
The contents of this document can be modified without prior notice. During the preparation of this document, all efforts were made to ensure its exhaustiveness. Alinof Software GmbH declines any responsibility in relation to possible errors or omissions in the contents of this document. Alinof Software GmbH is not responsible for incidents resulting from the use of information contained in this document. Alinof Software GmbH reserves the right to modify the product and the documentation without informing the users.
Warranty
The software is provided “as is”. The user assumes all the risks related to its use. Alinof Software GmbH does not grant any guarantee and cannot be held responsible in any case for possible direct, indirect, special, accidental, or additional damage or of any other nature (including the loss of data) whatever the causes are (including by negligence). This exclusion of guarantee also applies in a case in which Alinof Software GmbH has been informed of the possibility of such damages. Some jurisdictions do not allow the complete exclusion of warranties or limitation of certain rights to users. It is therefore possible that certain conditions mentioned above do not apply to you.
ANY ILLEGAL USE OF OUR PRODUCTS IS STRICTLY PROHIBITED. YOU ASSUME THE COMPLETE RESPONSIBILITY FOR A LEGAL AND RESPONSIBLE USE OF OUR PRODUCTS.
